The actor's young son is allegedly suing Ventura County, California, where his mother died in July.

United Water Conservation District and the county's Parks and Recreation Management are also allegedly named in for the papers for wrongful death and negligent infliction of emotional distress.

Their complaint is that Naya's death was preventable, say the papers, which the magazine had a copy of.

It also alleged that the boat Naya and Josey had rented from Lake Piru did not meet U.S Coast Guard safety standards.

The alleged complaint reads: "[The boat] was not equipped with a safely accessible ladder, adequate rope, an anchor, a radio or any security mechanisms to prevent swimmers from being separated from their boats.

"Disturbingly, later inspection revealed that the boat was not even equipped with any flotation or lifesaving devices, in direct violation of California law, which requires that all pontoons longer than 16 feet be equipped with flotation devices."

After a missing person's search, the Glee actress' body was found five days after she went missing.

She had taken a boat out with Josey on Lake Piru on 8 July.

The coroner's death certificate declared the 33-year-old actress died by accidental drowning.

Ventura County Police Department said at the time that Naya likely used her last bit of strength to push Josey to safety on the boat but she wasn't able to save herself.
